  • RTPR: Up-to-Date Information Regarding the Crossing of the Border from Ukraine to Romania

    Border points

    Direct crossing to Romania through: Siret, Isaccea, Albita, Sighetu Marmației and Halmeu.

    Crossing in Romania through the Republic of Moldova through the following crossing points: Lipcani-Rădăuți-Prut, Costești-Stînca, Sculeni-Sculeni, Ungheni-Iași, Leușeni-Albița, Cahul-Oancea, Giurgiulești-Galați.

    Necessary documents

    IMPORTANT: Border crossing is made under flexible conditions, as follows:

    Adult Ukrainian citizens (over 18 years)

    •  Entering on the basis of a valid simple or biometric passport.
    •  Expired passport, national identity card or no document: it is allowed to cross only by land (car, bus, train or by foot), but only as an asylum seeker at the border point.
    •  Ukrainian men aged between 18 and 60 are allowed access to Romania if they meet the conditions for leaving Ukraine1 and also those for entering Romania. Men that crossed the border illegally when leaving Ukraine and that wish to stay in Romania must apply for asylum or, if they are only transiting through Romania, they will be placed in refugee centers to give a declaration as a war refugee with the obligation to leave the territory of Romania in 15 days.

    Minors

    All children coming from Ukraine are accepted in Romania with or without documents. Accepted documents are: birth certificate or other identity card (e.g. passport, documents that attest their identity). Children may cross with both parents / one parent / or alone.

    For minors that cross with a single parent, the approval of the other parent is not required. In the case of children accompanied by relatives, proof of kinship must be provided, otherwise they will be considered alone. Children crossing unaccompanied / considered to cross unaccompanied are placed in refugee centers and placed in the care of a guardianship authority, asylum applications for these children are treated with priority.

    Foreigners crossing from Ukraine 

    Third-country nationals residing in Ukraine can cross the border on the basis of a valid passport and they obtain visa upon arrival. They can also apply for asylum.

    COVID-19 rules

    Upon entering Romania by land, it is not necessary to present a vaccination certificate / green certificate or a valid PCR test and no quarantine is required.

    Entering Romania by car

    If the green card / mandatory car insurance for abroad does not have coverage in Romania / EU, it is permitted to pass the border, but  a border insurance has to be acquired in Romania for 30 days

    Pets

    For crossing the border with a pet there is a temporary derogation regarding animals that do not have a rabies vaccine or that have an expired vaccine / do not have a microchip / identification tattoo. Therefore, the border can be crossed freely with these animals, but the Pet Location Form must be filled and the subsequent fulfillment of the requirements mentioned on the site ansvsa.ro shall be considered.

  • Dentons Advises Banks on Refinancing of Tristone Flowtech Group

    Dentons has advised a club of banks led by Erste Group Bank on the refinancing of the Tristone Flowtech Group. Freshfields Bruckhaus Derringer reportedly advised Tristone Flowtech.

    According to Dentons, “The Tristone Flowtech Group is a leading global supplier of engine and battery cooling to the automotive sector. It has operations in China, the Czech Republic, France, Germany, India, Italy, Mexico, Poland, Slovakia, Spain, and Turkey.”

  • Motieka & Audzevicius: Information for the Ukrainian Citizens Relocating to Lithuania

    Arriving in Lithuania

    Upon arrival in Lithuania, Ukrainian citizens must register in the Registration Centre (Pramonės g. 1B, Alytus, the address may change). Only in-person registration is possible.

    Documents needed: any document that can prove one’s identity will suffice. Ukrainian citizens are exempt from the requirement to provide travel documents, health insurance, or other relevant documents proving their lawful entrance to Lithuania if they are unable to do so for objective reasons. There are no translation requirements.

    Ukrainian citizens without an identity document will still be able to enter Lithuania. They will be issued an alien’s registration certificate.

    All migration procedures for Ukrainian citizens are free of charge.

    Ukrainian nationals are exempt from the requirement to be in possession of a visa for stays of no more than 90 days in any 180-day period, however, it is highly recommended to apply for a national visa or a temporary residence permit immediately upon arrival.

    Ukrainian citizens will be able to fill out a questionnaire in the Registration Centre. The answers will determine whether a person is eligible for a visa or a temporary residency permit.

    • Ukrainian citizens with biometric passports can apply for either a national visa available for the period of one year or a temporary residence permit for the period of one year.
    • Ukrainian citizens without biometric passports can only apply for a temporary residence permit for the period of one year.

    No return or expulsion decisions will be taken in respect of Ukrainian nationals and their family members. Ukrainian citizens who currently reside in Lithuania illegally can apply for a national visa or a temporary residency permit.

    Temporary accommodation options

    Ukrainian citizens who do not have a place of residence will be provided with temporary accommodation.

    Options:

    • During the migration procedures Ukrainian citizens will be able to stay in the Alytus Registration Centre for up to 72 hours;
    • Temporary accommodation supplied by the Lithuanian municipalities (up to 11.000 places of temporary accommodation currently offered);
    • Temporary accommodation supplied by the non-governmental initiative “Stiprūs kartu” (in the places of residence registered by the Lithuanian citizens. It is expected that around 10.000 Ukrainian citizens will be able to use this option);
    • Temporary accommodation options such as hotels, airbnb.combooking.com, and other housing services.

    Rights granted by the visa or the temporary residence permit:

    Ukrainian citizens with either a visa or a temporary residence permit are eligible to:

    • Receive free urgent basic medical aid;
    • Immediately start working in Lithuania without a work permit;
    • Declaring a place of residence;
    • Opening a bank account;
    • Continuing education in Lithuanian schools;
    • And other.

    Important contacts:

    • Questions regarding migration, visas, temporary residence permits, and temporary accommodation are overlooked by the Migration Department under the Ministry of the Interior of the Republic of Lithuania. Urgent questions can be answered through a special hotline (+37052717112) every day from 7:30 until 21:00.
    • Various questions regarding housing, education, and other similar matters after relocation to one of the Lithuanian municipalities are overlooked by those specific municipalities.
    • Questions regarding employment are overlooked by the Employment Service Under the Ministry of Social Security and Labour of the Republic of Lithuania.
    • Questions regarding health insurance are overlooked by the National Health Insurance Fund under the Ministry of Health.
    • Consultations and services regarding residence permits, health and social insurance, employment, and other questions are also provided by „International House Vilnius“.

  • Asters: Ways to Support Ukraine Now

    Asters, March 1, 2022: On 24 February 2022, Russia launched a full-scale invasion of Ukraine. Not only military facilities, but also civilian areas and objects (residential buildings, hospitals, kindergartens, etc.) are under the indiscriminate attack of the Russian forces.

    The brutal and cynical war started by Russia not only threatens the sovereignty of Ukraine, but also jeopardizes the security system of the entire world. The ongoing heroic battle of Ukrainian soldiers and all Ukrainian people currently prevents the expansion of Putin’s tyrannical dictatorship further into Western Europe.

    We are deeply touched by that expression of the solidarity and support of Ukraine, the assistance provided to our country and the severe sanctions already imposed on the aggressor by foreign states and organizations.

    • People in need. The organization provides humanitarian aid in critical situations. Donations will go for providing Ukrainians with food packages, emergency shelters, safe access to drinking water, hygiene items, and coal for heating. You can donate via its website;
    • The UN Refugee Agency. The donations will help displaced Ukrainians with emergency supplies, lifesaving care and protection. You can donate via its website;
    • CARE. The organization helps Ukrainians with urgently needed water, food, hygiene kits, and ongoing support in Ukraine. You can donate via its website.
    1. Block and ignore all Russian propaganda media, such as Russia Today, RTR, RIA Novosti, etc.
    2. Use and share only reliable sources of information. You may rely on the following official Ukrainian sources:
    1. Express your support of Ukraine to the government of your state, business partners and colleagues to intensify military and other assistance for Ukraine, as well as to facilitate imposing as severe as possible sanctions on Russia.

    The entire CEELM team has been following the war in Ukraine unfold with a deep sense of powerless concern. At such a trying time for all our readers, partners, and friends in Ukraine we at CEELM wish to extend our deepest wishes for their safety and the safety of their loved ones. We still hope this unnecessary conflict comes to a swift and peaceful conclusion.

    As a legal trade journal, we doubt we have the ear of those who might bring the status quo to anything resembling normality, but maybe we have the ear of some who do have it. As such:

    • CEELM is placing under indefinite embargo any coverage coming out of, or related to, Russia and Belarus.
    • We will also not be awarding a Deal of the Year award for Russia and Belarus this year.

    In parallel, a #StandWithUkraine section was created on our platform where, unlike any other coverage by CEELM, all open calls for support will be shared unedited with hyperlinks to resources left in. We will only remove marketing-speak qualifiers and announcements of donations made – this is a platform for open calls and critical announcements during a time of crisis, not an opportunity for marketing visibility.

  • KNP Law: Lawyers for Ukraine – International Initiative Has Been Launched

    KNP Law, February 28, 2022: In 3 days, more than 2000 lawyers from many countries have joined the online lawyer database, which provides free legal aid to those fleeing Ukraine.

    The site https://ukrainelegalaid.org/ has been live since Sunday and serves a dual purpose. On one hand, lawyers from all over the world can apply, who can provide free legal aid to refugees from Ukraine, also those who are forced to leave their homes can search the database. Lawyers can specify their location, their jurisdiction and their asylum and refugee experience. Of course, all lawyers undertake to provide advice pro bono, free of charge. The site is currently available in English, Ukrainian, Russian and Polish, but will soon be available in Hungarian and other languages.

    The collaboration started in Hungary when Oliver Koppany of KNP LAW took to social media. “I posted on LinkedIn and Instagram that if there are any of my friends who can and want to help, get in touch with me. In the first few hours, we received more than 400 emails, and on Friday and Saturday we organized the data with my colleagues, and with the involvement of developers, we put together a searchable database and a contact form on Sunday” – the lawyer said. The initiative went viral on Instagram on the BigLawBoiz account, and is being picked up by North American Biglaw firms as well, including Willkie Farr & Gallagher.

    It started as a Google Spreadsheet, and now has evolved into a searchable, useable database supported by developers around the world to make it as easy to use as possible.

    At present, the vast majority of the lawyers registered are from North America, so it would be very important for as many European lawyers as possible to reach out – also they are looking forward to spread the information amongst NGO’s, governments and municipalities that are involved or related to the crisis.

  • Konieczny Wierzbicki: Ukrainians Staying in Poland – Practical Information

    Due to Russia’s armed attack on Ukraine, many Ukrainian citizens have lost or been forced to hurriedly abandon their households and seek help from foreign neighbors. Poland is one of the countries Ukraine has access to almost immediately.

    Polish officials were also quick to decide on additional formal facilitations for Ukrainian refugees. The following guide is a comprehensive overview of what the current conditions for crossing the Polish-Ukrainian border look like. We encourage you to read the following information verified by our lawyers.

    Entry into Poland following the current (28.02.2022) regulations:

    1. based on a biometric passport – a stay of up to 90 days is permitted; during this period you can submit an application for a residence and work permit, an application for a residence permit, an application for a work permit; work is also possible based on a statement on entrusting work to a foreigner, but this is a solution for a maximum period of 24 months, during which time a work permit or a residence and work permit must be obtained).

    2. based on a national visa (type D) or Schengen visa (type C), including those issued by an authority of another EU member state.

    3. Residence permit (temporary, permanent, long-term EU resident).

    4. Application for international protection (for refugee status).

    5. Consent of the Border Guard Commander to an entry for a period of up to 15 days.

    In practice – the Polish administration declares (https://www.gov.pl/web/udsc/ukraina; information of 27.02.2022) that anyone running from Ukraine from the war can find a shelter in Poland and does not have to worry about the legality of their stay, because Polish services will take care of extending the authorization for as long as needed. There are also reports that the EU intends to allow Ukrainians to stay in the EU for up to three years without additional formalities (“An overwhelming majority of EU countries support a proposal to allow refugees from Ukraine to stay in member states for at least three years. The formal decision will come soon, reports the New York Times” [for: onet.pl, g. 23.03 on 27.02.2022]).

    Reduced requirements for documents: Polish border guards will let through the Ukrainian border also people who do not have a foreign passport. Any other document confirming identity (passport, internal passport, birth certificate in case of children without other documents) is sufficient.

    Stay in Poland

    1. Ukrainians with biometric passports may stay in Poland for up to 90 days under a visa-free regime.

    2. People holding a residence permit may stay in Poland until the expiry of the period for which the permit was issued. The Polish authorities declare that those, whose residence permits are about to expire need not fear any consequences – the legality of their stay in Poland will be extended.

    3. People who have entered Poland without documents (based on a permit issued by the Commander of the Border Guard) may stay in Poland for 15 days. During that time they should apply to the provincial office for a temporary residence permit or residence and work permit. This should be done by post – applying is equivalent to obtaining the right of legal residence until the application is examined.

    4. Those, who have applied for international protection (refugee status) stay legally in Poland until their application is examined; however, they cannot work, nor will they be able to work for the first 6 months after being granted protection.

    Work in Poland

    Currently work in Poland is legal for persons who have a work permit, a residence and work permit, a residence permit for a long-term EU resident, and also for persons for whom the employer submitted to the Labor Office a statement on entrusting work to a foreigner.

    1. Those, who wish to apply for a residence permit or a residence and work permit after crossing the border based on a Border Guard permit, must file an appropriate application to the Provincial Office competent for the place of residence. As a law firm, we provide application filing services.
    2. Those, who stay in Poland under the visa-free regime (up to 90 days), can apply for a residence and work permit during that time; if they find a job, they can also obtain the possibility to work based on an employer’s declaration of entrusting work to a foreigner. The declaration allows you to work for up to 24 months, in which case you must apply for a residence and work permit before the expiry of the 90-day visa-free period. We support employers in submitting declarations and employees in obtaining documents entitling them to legal stay in Poland.

    Those, who have applied for international protection (refugee status) cannot work until they are granted international protection. They will also be unable to work for the first 6 months after being granted protection.

    Medical care

    All Ukrainian citizens who have entered Poland in connection with the Russian invasion may receive free medical assistance in Polish health care facilities, if necessary. This applies to Ukrainian who have a certificate issued by the Border Guard of the Republic of Poland or an imprint of the stamp of the Border Guard of the Republic of Poland in their travel document, confirming their legal stay in the territory of the Republic of Poland after crossing the border from 24 February 2022.

    1. Medical care will be provided by general practitioners (primary health care) and in specialist clinics or hospitals.
    2. Child who does not have a passport or other Ukrainian identification document can cross the border – based on birth certificate only. For Adults obtaining a foreign passport on the territory of Poland is possible by agreement with consular authorities of Ukraine and the legislation of Ukraine. However currently, according to information obtained from the Consulate of Ukraine, foreign passports are not issued, and consular services are suspended.
    3. All children, regardless of their basis of residence, aged 7-18 are subject to compulsory education in Poland. A child may be admitted to school throughout the school year. He/she will be referred to a class depending on the number of years of education completed abroad. The enrolment of a child to school takes place by applying the school principal. The public elementary schools in the area where the child lives accept the child in question ex officio. In the case of choosing other elementary schools and secondary schools, it is possible depending on the availability of places. To find out which school has free places, one should contact the education department of the municipality where the child lives.

    Animals

    Animals accompanying the traveler (dogs, cats, and ferrets) should have:

    1. A chip/transponder or legible tattoo identifying the animal.
    2. Rabies vaccination.
    3. A health certificate and documentation detailing the animal’s identification, as well as vaccination details and serological test results.
    4. The result of the rabies antibody titration test.

    However, according to information published by the Chief Veterinarian, entry with an animal from Ukraine is now possible, even if the above requirements are not fulfilled. A temporary procedure has been implemented, providing for the submission of a declaration by the owner/guardian of the animal. It is not necessary to have a rabies test result.

  • Avellum: Statement on the Russian War Against Ukraine

    On 24 February 2022, Russia started a full-scale invasion of Ukraine, being part of its aggression against our country commenced in 2014. Europe has not seen armed conflicts of such scale and brutality for decades. Reliable evidence confirms that Russian troops are making indiscriminate attacks including air raids, ballistic missile strikes and bombings. Residential housing, utilities, critical infrastructure are being destroyed all over Ukraine. The United Nations reports at least 240 civilian casualties and 64 deaths in Ukraine as of 26 February 2022. Apart from that, hundreds of thousands of peaceful Ukrainians had to flee violence to Western Ukraine and neighboring countries.

    Russia’s leaders do not conceal that the purpose of such barbaric act is to undermine the sovereignty of Ukraine, while Ukraine has been demonstrating for many years that freedom and independence are paramount values of Ukrainians. Every sovereign state must decide its own destiny.

    AVELLUM team has already been helping Ukraine to survive supporting financially, or by joining territorial defence units, or by volunteering and doing what they can to help our home country.

    Despite all valuable assistance international community and Ukraine’s allies provided to date, this may not be enough and further support is vital for Ukraine to prevail.
